How can I report suspected wrongdoing?

In accordance with Act No. 171/2023 Coll., on the protection of whistleblowers, it is possible to report a possible illegal act in the company KOMA – Industry s.r.o. (hereinafter referred to as KOMA) through the internal notification system, in the form of:

a) in writing

  • via the email address below,
  • by mail to the address Ruská 41, 706 02 Ostrava – Vítkovice. In the case of submitting a notification by post, the envelope must be marked with the inscription “DO NOT OPEN – only to the hands of the competent person to receive and process notifications of possible illegal acts according to the Act on the Protection of Whistleblowers”.

b) orally

  • by phone at the number below,
  • through the voice message system,

c) in person at the request of the informant after prior telephone arrangement.

All documents that are an integral part of the internal reporting system are available from the appropriate person.

External notification system

Another way to report a possible illegal act is through the external notification system of the Ministry of Justice, at the Internet address https://oznamovatel.justice.cz/chci-podat-oznameni/.

Who can make a notification?

At KOMA, it was decided that notifications of possible illegal behavior are accepted from persons who have performed or are performing work or other similar activities for KOMA. According to the provisions of § 2, paragraph 3, this is dependent work performed in a basic employment relationship, service, volunteer activity, professional practice, internship, or applying for a job or other similar activity. The same applies to notifications of possible illegal behavior also from persons who were or are in contact with KOMA in connection with the performance of work or other similar activities.

The notification must include the name, surname and date of birth of the notifier.

The whistleblower should be able to identify the area of ​​the illegal act and think about what verifiable information he can provide about the reported illegal act. The extent and quality of the information submitted can positively influence the way the notification is investigated. The filing of a knowingly false report may be sanctioned under the Act on the Protection of Whistleblowers.

Protection of whistleblower’s personal data

The notifier has all the rights arising from the legal system (in particular from Regulation (EU) 2016/679 and Regulation (EU) 2018/1725). The whistleblower’s identity will not be disclosed without his express consent to anyone except the appropriate person – the representative for the internal whistleblower system according to the Act on the Protection of Whistleblowers. The same applies to any other information from which the identity of the whistleblower could be deduced directly or indirectly.

 Personal data are processed in relation to the notification on the basis of Article 6 paragraph 1 letter c) of the General Regulation on the Protection of Personal Data (hereinafter referred to as “GDPR”).
